The birth and expansion of Islam were accompanied by the gradual establishment of an original normative system and its institutions, in different configurations according to place and time.
Contact or confrontation with European-inspired modernity led to the upheaval, of this normative system, which was transformed, in most societies with a strong Muslim presence, into a system of positive law of the civilist type most often, into a system of common law if not. In certain specific areas, especially family law, the former Islamic normative system has been transformed into a system of positive Muslim law. More recently, new forms of normativity have emerged under the influence of the globalisation of modes of governance and, in particular, the widespread use of managerial norms.
